Pre-Trial Diversion Program

The goal of the Madison County Pre-trial Diversion Program is to give individuals charged with an infraction or misdemeanor an opportunity to avoid receiving a criminal conviction on their record. Individuals charged with an infraction or misdemeanor who meet certain requirements may apply to participate in this program. Successful completion of this program results in dismissal of charges.

 

If you are charged with an infraction or misdemeanor and meet the requirements listed below, you may qualify for the Prosecutor’s Pre-Trial Diversion Program:

Requirements for Misdemeanors:

  • No prior convictions
  • Must attend initial hearing and enter a plea of “not guilty”
  • Total Diversion Fees and Court Costs $334.00 (non-moving) or $334.50 (moving)
  • 12 month participation in the Pre-Trial Diversion Program
  • Additional classes may be required by the Pre-Trial Diversion Director

Requirements for Infractions:

  • No moving violations in the past six months
  • No prior participation in the Pre-Trial Diversion Program
  • Total Diversion Fees and Court Costs $180.50
  • Six month participation in the Pre-Trial Diversion Program
  • Community Service required for participants ages 16-19

The program excludes certain types of cases, such as cases involving guns, seatbelt violations and driving under the influence.
